Welcome to www.cospicon.com, the official online store of COSPICON S.A. These Terms and Conditions (“Terms”) govern your use of our Website and the purchase of products through it. By accessing the Website, browsing its content, or placing an order, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, please do not use the Website or place orders.


1. Company Information

COSPICON S.A. is a Greek manufacturer of premium aluminium bioclimatic pergolas, canopies, and outdoor architectural systems. We sell our products directly to consumers and businesses worldwide through this Website, in compliance with applicable Greek and European Union legislation.


2. Definitions

  • “Company”, “we”, “us”, “our” refers to COSPICON S.A.
  • “Customer”, “you”, “your” refers to any natural person or legal entity placing an order through the Website.
  • “Website” refers to www.cospicon.com and its eshop.
  • “Products” refers to bioclimatic pergolas, canopy doors, motors, accessories, and any other goods offered for sale on the Website.
  • “Order” refers to a purchase request submitted by the Customer through the Website’s checkout process.
  • “Custom-Made Products” refers to products manufactured according to specifications selected by the Customer (e.g., dimensions, color, material, motor configuration).

3. Products & Specifications

Most products offered through this Website, including all pergola models and canopy doors, are Custom-Made Products manufactured to order based on the specifications selected by the Customer at the time of purchase. By placing an order, you acknowledge that:

  • Each product is manufactured specifically for your order based on the selected configuration (dimensions, color, material, motor type, accessories).
  • Production begins after order confirmation and payment receipt.
  • Once production has commenced, the order cannot be modified or cancelled (see Section 7 below).
  • Slight variations in color, finish, or dimensions (within manufacturing tolerances of ±2mm) may occur and do not constitute a defect.
  • Product images on the Website are for illustrative purposes; minor visual differences may exist between online representation and the final product.

Technical specifications, materials, and product features are described on each individual product page. We reserve the right to modify product specifications, designs, or features without prior notice in order to improve quality.


4. Pricing & Currency

All prices are listed in EUR (€) and represent the final price including all applicable manufacturing costs.

  • VAT (24%) applies only to orders shipped within Greece. Orders shipped outside Greece are exempt from Greek VAT.
  • Customs duties, import taxes, and clearance fees for destinations outside the European Union are not included in the price and are the responsibility of the Customer (DDU – Delivered Duty Unpaid).
  • USD prices are displayed for convenience only and are calculated based on the daily reference exchange rate of the European Central Bank. The actual transaction is always processed in EUR.
  • Prices may change without prior notice; however, the price applicable to your order is the one displayed at the time of purchase.
  • In the event of a typographical error or pricing mistake, we reserve the right to cancel the order and issue a full refund.

Shipping costs are calculated separately based on the destination zone and are displayed during checkout. See our Shipping & Delivery page for details.


5. Order Process & Acceptance

5.1 Order Placement

To place an order, you must complete the checkout process on the Website by providing accurate billing and shipping information, selecting your products and configuration, choosing a payment method, and confirming the order.

5.2 Order Acceptance

An order is considered provisionally accepted upon submission. You will receive an order confirmation email containing your order number and details. However, the order is only fully confirmed once:

  • Payment has been received and verified in our bank account; and
  • We have confirmed product availability, configuration feasibility, and production scheduling.

We reserve the right to refuse or cancel any order at our sole discretion, including (but not limited to) cases of suspected fraud, unavailability, pricing errors, or violation of these Terms. In such cases, we will notify you and issue a full refund of any payments received.

5.3 Order Confirmation

Upon full confirmation, you will receive a second email confirming production has begun, along with an estimated production lead time and shipping window.


6. Payment Terms

Currently, we accept the following payment methods:

  • Bank Transfer (Alpha Bank, Greece) – primary method for both domestic and international customers.

Detailed payment instructions are provided on our Payment Methods page and in your order confirmation email.

6.1 Payment Timing

  • Full payment must be received before production begins.
  • Domestic transfers (within Greece) typically clear within 1-3 business days.
  • International transfers may take 3-7 business days, depending on your bank and country of origin.
  • If payment is not received within 14 calendar days of order placement, the order will be automatically cancelled.

6.2 Reference Number

You must include your Order Number as the payment reference. Without it, we cannot match your payment to your order, which may delay processing or result in cancellation.

6.3 International Bank Charges

For international wire transfers, we recommend using the “OUR” charge code so that the full amount reaches us. If we receive an amount lower than the order total due to intermediary bank fees, you will be requested to pay the difference before production begins.


7. Order Modifications & Cancellations

7.1 Modifications

Order modifications (changes to dimensions, color, configuration, shipping address) may be requested by contacting us at info@cospicon.com within 48 hours of order placement, provided that production has not yet begun. After this period, modifications cannot be guaranteed.

7.2 Cancellations

Order cancellation by the Customer is permitted under the following conditions:

  • Within 48 hours of order placement and before production has begun: Free cancellation, with full refund of any payments received.
  • After production has begun but before shipment: Cancellation may be subject to a fee of up to 50% of the order value, to cover materials and labor already invested. The exact fee will be communicated to you upon request.
  • After shipment: Cancellation is no longer possible. Please refer to Section 9 (Returns & Warranty) regarding defective products.

Cancellation requests must be submitted in writing to info@cospicon.com.


8. Production & Delivery Times

8.1 Production Lead Time

As products are manufactured to order, a production lead time applies before shipment. The estimated production time will be confirmed in your order acceptance email and is influenced by:

  • Product type and configuration complexity
  • Current production capacity
  • Material availability
  • Custom features or non-standard requests

Production lead times are estimates only and are not guaranteed. Cospicon shall not be liable for delays caused by factors beyond its control (see Section 14 – Force Majeure).

8.2 Shipping Time

Shipping times begin from the moment the product is dispatched, not from the order date. Estimated shipping times by destination zone are detailed on our Shipping & Delivery page.

8.3 Total Time to Delivery

Total time = Production lead time + Shipping time. Both will be communicated to you at order confirmation.


9. Shipping, Customs & Delivery

9.1 Shipping

We ship worldwide. Shipping rates and estimated delivery times are detailed on our Shipping & Delivery page. Shipping costs are calculated automatically at checkout based on your destination.

9.2 Customs Duties (Non-EU Destinations)

For destinations outside the European Union, all customs duties, import taxes, VAT, and clearance fees imposed by the destination country are the sole responsibility of the Customer. These charges are not included in the product price or shipping cost.

Cospicon ships under DDU (Delivered Duty Unpaid) terms. The Customer is the importer of record and is responsible for compliance with all import regulations, taxes, and licensing requirements applicable in the destination country.

Failure to pay customs duties or refusal of delivery does not entitle the Customer to a refund. Returned shipments due to unpaid customs charges or refused delivery will incur return shipping costs and may be deducted from any potential refund.

9.3 Risk and Title Transfer

Risk of loss or damage to the products passes to the Customer upon delivery to the carrier. Title to the products remains with Cospicon until full payment has been received and the products have been delivered.

9.4 Inspection on Delivery

Customers are required to inspect packages upon delivery and report any visible damage or missing items within 48 hours by contacting info@cospicon.com with photographs and a description of the issue.


10. Returns & Refunds

10.1 Custom-Made Products – Right of Withdrawal Exception

In accordance with Article 16(c) of Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal does not apply to products that are made to the consumer’s specifications or are clearly personalized.

All pergolas and canopy doors offered on this Website are Custom-Made Products manufactured according to the dimensions, colors, materials, and configurations selected by the Customer. As such, the standard 14-day right of withdrawal does not apply to these products.

10.2 Defective Products & Manufacturing Defects

If you receive a product that is defective, damaged in transit, or does not conform to your order specifications, please contact us within 48 hours of delivery at info@cospicon.com with:

  • Your order number
  • A description of the issue
  • Photographs and/or video clearly showing the defect or damage
  • Photographs of the original packaging (for transit damage claims)

Upon verification, we will, at our discretion, offer one of the following remedies:

  • Replacement of the defective component or product (free of charge)
  • Repair (with parts and labor covered by Cospicon)
  • Partial or full refund (in cases where replacement or repair is not feasible)

10.3 Non-Defect Returns

Returns based on personal preference, change of mind, incorrect measurements provided by the Customer, or unsuitability of the product for its intended use are not accepted, due to the custom-made nature of our products.

10.4 Refund Processing

Approved refunds will be processed within 14 days of approval, via the same payment method used for the original transaction (bank transfer to the Customer’s account).


11. Warranty

11.1 Standard Warranty

Cospicon products are covered by a 5-year manufacturer’s warranty against manufacturing defects, structural failures, and material flaws under normal use, starting from the date of delivery.

11.2 What Is Covered

  • Structural integrity of aluminium frames
  • Manufacturing defects in materials and workmanship
  • Mechanical components (motors, hinges, fasteners) according to the warranty terms of their respective manufacturers (e.g., Somfy motors)
  • Surface treatments (powder coating) under normal weather exposure

11.3 What Is Not Covered

  • Damage caused by improper installation (where installation was not performed by Cospicon-certified technicians)
  • Damage from extreme weather events (e.g., hurricanes, hailstorms beyond design specifications)
  • Damage from misuse, neglect, or unauthorized modifications
  • Normal wear and tear
  • Cosmetic damage that does not affect functionality
  • Damage from improper cleaning or use of harsh chemicals

11.4 Warranty Claims

To submit a warranty claim, contact info@cospicon.com with your order number, photographs, and a description of the issue. We will evaluate the claim and respond within 10 business days.


12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Cospicon’s total liability arising from any order shall not exceed the total amount paid by the Customer for that specific order.
  • Cospicon shall not be liable for indirect, consequential, incidental, or punitive damages, including but not limited to loss of profits, loss of business, loss of use, loss of data, or property damage caused by use or installation of the products.
  • Cospicon makes no warranties or representations beyond those expressly stated in these Terms.
  • The Customer is responsible for ensuring that the product, as configured, is suitable for the intended use, location, and applicable local building regulations.

Nothing in these Terms shall limit Cospicon’s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.


13. Installation & Local Regulations

Cospicon products may require professional installation. Unless otherwise agreed, installation services are not included in the product price and are the responsibility of the Customer.

The Customer is solely responsible for:

  • Compliance with local building codes, planning permissions, zoning laws, and homeowner association rules
  • Verifying that the product, as configured, is appropriate for the installation location
  • Ensuring proper site preparation (foundations, anchoring points, electrical connections for motorized models)
  • Hiring qualified installers

Cospicon does not assume liability for any planning, regulatory, or zoning issues that may arise after delivery.


14. Force Majeure

Cospicon shall not be liable for any failure or delay in performance of its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, fires)
  • War, terrorism, civil unrest, riots
  • Government actions, embargoes, sanctions
  • Strikes, labor disputes, transportation delays
  • Pandemics or epidemics
  • Failure of utilities, internet, or banking systems
  • Supplier failures or material shortages

In such cases, performance shall be suspended for the duration of the event, and delivery times shall be extended accordingly. The Customer will be notified as soon as reasonably possible.


15. Intellectual Property

All content on this Website, including but not limited to text, images, logos, product designs, technical drawings, videos, and trademarks (such as “Cospicon”, “CospiBio”, “Cospi Bio S”, “CospiBio Flat”), are the exclusive property of COSPICON S.A. or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any Website content without prior written authorization from Cospicon.


16. Privacy & Data Protection

Your privacy is important to us. The collection and processing of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms.


17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Hellenic Republic (Greece) and applicable European Union legislation, without regard to conflict of law principles.

Any dispute arising from or related to these Terms or your use of the Website shall fall under the exclusive jurisdiction of the competent courts of Athens, Greece.

For consumers residing in the European Union, this clause does not affect mandatory consumer protection rights granted under the law of your country of residence.


18. Online Dispute Resolution (EU Customers)

Pursuant to Regulation (EU) No 524/2013, EU consumers have the right to use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes arising from online purchases:

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.


20. Modifications

Cospicon reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a new “Last updated” date. Continued use of the Website after such changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

For ongoing orders placed before a Terms update, the Terms in effect at the time of the order shall apply.


21. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Shipping & Delivery page, and Payment Methods page, constitute the entire agreement between you and Cospicon regarding your use of the Website and the purchase of products. They supersede any prior agreements, communications, or understandings.
